Wizard Parking Terms of Use

These Terms of Use ("Terms") govern your use of the Wizard Parking websites (including wizardparking.com and wizard.nyc), mobile apps, and related services (together, the "Platform"). The Platform is operated by Wizard Parking LLC, a Delaware limited liability company ("Wizard Parking," "we," "us," or "our").

By creating an account, making a reservation, or otherwise using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

Please read the Dispute Resolution section carefully. It requires most disputes to be resolved by individual arbitration instead of in court, waives class actions, and explains how to opt out.

1. Who can use Wizard Parking

You must be at least 18 years old and able to enter a binding contract. By using the Platform, you confirm that you meet these requirements.

2. What Wizard Parking does

Wizard Parking is an online marketplace. We show parking offered by independent garage and lot owners and operators ("Operators"), let you book it, and collect payment on the Operator's behalf.

Wizard Parking does not:

  • own, operate, or manage parking facilities;
  • take possession, custody, or control of your vehicle;
  • employ facility staff or control how facilities are run; or
  • set the parking rates Operators charge.

At the facility, the Operator is responsible for the premises, its staff, its security, and your vehicle while parked. Claims for vehicle damage, theft, or injury at a facility should be directed to the Operator. We can help you identify the right Operator contact.

3. Operator rules

Each facility has its own rules, such as hours, height limits, oversized-vehicle charges, in-and-out privileges, and towing policies ("Operator Rules"). Operator Rules may be posted at the facility, shown on the listing, or printed on your parking pass. By booking, you agree to follow them.

4. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email or in the app at least 14 days before they take effect, unless the law requires a faster change. Changes do not apply to reservations already booked or to disputes that arose before the change.

If you keep using the Platform after the effective date, you accept the updated Terms.

5. Making a reservation

A reservation gives you permission to park one vehicle at the listed facility during the booked time window. It does not hold a specific numbered space unless the listing says so.

You are responsible for entering accurate booking details: facility, date, times, and, where required, your license plate and vehicle. Wizard Parking is not responsible for tickets, towing, or extra charges caused by incorrect details you enter.

To use a reservation, follow the entry instructions on your parking pass, such as scanning a QR code or having your plate read at the gate.

6. Arriving early or staying late

Your reservation covers only the booked window. If you enter before it starts or leave after it ends, the Operator may charge its posted rates for the extra time. Those charges are between you and the Operator.

7. Pricing and fees

Operators set their parking rates. The price shown on our map and at checkout is the all-in price, which includes:

  • the Operator's parking rate;
  • an oversized-vehicle fee, if your vehicle requires one;
  • applicable taxes; and
  • a Wizard Parking service fee, if one applies.

The all-in price is what we charge, and we do not add fees afterward. Oversize fees depend on the vehicle details you enter, so enter them accurately. The Operator may charge you on-site if your vehicle doesn't match your booking, or for items outside your reservation, such as overstays or EV charging.

Reservation rates cannot be combined with coupons, validations, or discounts offered at the facility unless the listing says so.

8. Payment

You authorize us to charge your selected payment method for each reservation and monthly pass purchase. Wizard Parking collects your payment as the Operator's limited payment collection agent, and your card statement will show "WIZARD PARKING". Payments are processed by Stripe, Inc. through Stripe Connect, and we never see or store your full card number.

When you pay for a reservation through the Platform, your obligation to pay the Operator for that reservation is satisfied. If a charge fails, we may retry it or ask you for another payment method. Card networks may send Stripe updated card details, which may be used to avoid failed charges.

9. Taxes

Taxes are included in the all-in price. Operators are responsible for their tax obligations. We pass each Operator its share of your payment, including taxes, minus our commission, and the Operator remits taxes to the proper authorities.

10. No resale

Reservations are for your own use or your organization's use. You may not resell a reservation or transfer it for profit. We may cancel resold reservations without a refund.

11. Changing or cancelling a reservation

You may change your reservation's date, time, or vehicle any time before its start time. If the change raises the price, we charge the difference; if it lowers the price, we refund the difference.

You may cancel an hourly or daily reservation for a full refund any time before its start time. If a listing shows a different policy before you book, the listing's policy controls.

Once a reservation starts, it is non-refundable, even if you arrive late, don't use it, or plans change because of traffic, weather, or event changes. We may offer account credit after the start time at our discretion.

Refunds go back to your original payment method. Your bank may take several business days to post them.

12. If something goes wrong

If you arrive during your reservation and can't park because the facility is full, closed, or won't honor your pass, contact us right away at support@wizardparking.com. We will refund your reservation in full. We may point you to other parking on the Platform, but any new reservation is booked and paid for separately.

A refund of your reservation is your sole remedy from Wizard Parking when a facility can't honor it. We do not reimburse the cost of parking elsewhere.

Report problems within 24 hours. To request a refund or credit for any reservation issue, contact us within 24 hours after the reservation's start time. For reservations longer than 24 hours, you may report a problem any time before the reservation ends. Include your pass number and any receipts. We may decline later requests, because we can no longer verify them with the Operator.

This window applies to requests made to Wizard Parking. It does not limit any legal right you have, or your right to dispute a charge with your card issuer.

We review each claim individually. We may suspend accounts that abuse this policy.

13. Monthly parking passes

Some facilities offer monthly parking. Wizard Parking helps you find and start it, but your ongoing monthly arrangement is with the Operator.

What you pay us. When you book a monthly pass, we charge only your first month, at the all-in price shown. We do not bill you on a recurring basis.

Your agreement with the Operator. To continue past the first month, you sign up directly with the Operator. The Operator's monthly agreement governs later billing, renewal, price changes, access cards, and cancellation. Wizard Parking is not a party to that agreement.

Cancelling the first month. You may cancel a monthly pass for a full refund any time before its start date. After it starts, the first month is non-refundable. For later months, contact the Operator.

Facility rules. Monthly parking may carry extra Operator Rules, such as an access card, an assigned level, or set entry hours. If the Operator ends its monthly program or closes the facility during your first month, we will refund the unused part of that month.

Sharing your details. To set up your monthly agreement, we share your contact, vehicle, and booking details with the Operator, as described in our Privacy Policy.

14. Promotions and credits

We may offer promo codes, referral credits, or account credits. They have no cash value, cannot be sold or transferred, and may expire or carry conditions shown when offered. We may cancel credits obtained by fraud, error, or abuse. If we launch a referral program, its terms will be shown when you join it.

15. Your account

Some features require an account. Keep your information accurate and your login secure. Tell us promptly at support@wizardparking.com if you suspect unauthorized use.

You are responsible for activity under your account, unless it results from our failure to protect it. If your employer or organization manages your account, it may see your reservation details and control some settings.

16. Acceptable use

You agree not to:

  • use the Platform for anything illegal or fraudulent;
  • pay with a payment method you are not authorized to use;
  • scrape, crawl, or copy listings or content with automated tools, except public search engines we permit;
  • interfere with, overload, or try to gain unauthorized access to the Platform or its systems;
  • reverse engineer the apps, except as the law allows;
  • impersonate anyone or misstate your affiliation; or
  • use the Platform to harass or harm anyone.

17. Our content, your reviews, and feedback

The Platform, including its software, design, text, and the Wizard Parking name and logo, belongs to Wizard Parking or its licensors. We grant you a limited, revocable, non-transferable license to use it for booking parking.

Reviews. You may rate and review facilities you have booked. Reviews must reflect your honest, first-hand experience. Do not post reviews that are false, paid for, or about a business you own or work for, or that contain personal information, threats, hate speech, or illegal content.

You keep ownership of your reviews. By posting one, you give Wizard Parking a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute it on the Platform and in our marketing, with your first name and last initial. We may show shortened excerpts that don't change its meaning.

We may remove reviews that break these rules. We do not remove or hide reviews because they are negative, and Operators cannot pay to remove them. We will never penalize you for posting an honest review.

Feedback. If you send us suggestions or feedback, we may use them without obligation to you.

18. Text messages and notifications

We may send transactional texts and push notifications about your reservations, such as parking passes and reminders. With your separate consent, we may also send marketing texts. That consent is not a condition of purchase, and message and data rates may apply.

You can opt out of texts by replying STOP or by any other reasonable means, such as contacting support or changing your notification settings. We may send one message confirming your opt-out.

19. Suspension and termination

You may close your account at any time. We may suspend or close your account if you violate these Terms, commit fraud, or create risk for us, Operators, or other users.

If we close your account without cause, we will refund upcoming reservations, including monthly passes that haven't started.

20. Disclaimers

We provide the Platform "as is" and "as available." To the fullest extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Operators supply much of the listing information, and we don't guarantee it is always complete or current. Some states don't allow these disclaimers, so parts may not apply to you.

21. Limitation of liability

To the fullest extent the law allows:

  • Wizard Parking is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data.
  • Wizard Parking is not liable for loss of or damage to vehicles, their contents, or persons at a facility; those are the Operator's responsibility.
  • Our total liability for any claim about the Platform or these Terms is limited to the greater of what you paid us in the 12 months before the claim, or $100.

These limits do not apply where the law forbids them, such as for fraud or willful misconduct. Some states don't allow certain limits, so parts of this section may not apply to you.

22. Indemnity

You agree to indemnify Wizard Parking against third-party claims, including reasonable attorneys' fees, arising from your violation of these Terms, the law, or Operator Rules.

23. Dispute resolution

Informal resolution first. Before filing a claim, send a written notice describing the dispute and the relief you want to support@wizardparking.com with the subject line "Legal Notice." We will do the same before any claim against you. Both sides agree to try to resolve it informally for 60 days.

Arbitration. Unresolved disputes will be settled by binding individual arbitration, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. Hearings may be held by video or phone, or in the county where you live. If you start an arbitration, your share of fees is limited to the consumer filing fee set by the AAA's rules. Wizard Parking pays all other AAA administrative fees and the arbitrator's compensation. Each side pays its own attorneys' fees, unless the arbitrator awards them under applicable law.

Exceptions. Either party may bring an individual claim in small claims court. Either party may also go to court to stop infringement of intellectual property.

Class action waiver. Claims may be brought only individually, not as a plaintiff or class member in any class, collective, or representative proceeding. If this waiver is unenforceable for a claim, that claim goes to court, not arbitration.

Mass filings. If 25 or more similar claims are filed by the same or coordinated counsel, the AAA's Mass Arbitration Supplementary Rules will apply, and the cases may be administered in batches.

Opting out of arbitration. You may reject this arbitration agreement by emailing support@wizardparking.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Include your name, account email, and a statement that you opt out. If you opt out, disputes between us will be decided in court instead of arbitration, and the rest of these Terms still apply.

Jury waiver. If a dispute proceeds in court, both parties waive a jury trial to the extent the law allows.

24. Governing law and venue

These Terms are governed by the Federal Arbitration Act and the laws of the State of New York, without regard to conflict-of-law rules. Court proceedings allowed by these Terms will be in the state or federal courts in New York County, New York. You may bring small claims cases where you live.

25. General

  • Entire agreement. These Terms, the Privacy Policy, and any Operator Rules or listing terms shown at booking are the full agreement about the Platform.
  • Severability. If a court finds part of these Terms unenforceable, the rest stays in effect.
  • No waiver. A delay in enforcing a right doesn't waive it.
  • Assignment. You may not transfer these Terms. We may transfer them in a merger, acquisition, or sale of assets.
  • Independent businesses. Operators are not our agents, employees, or partners.
